With sentence no. 128 of June 22, 2021, the Constitutional Court has declared the constitutional illegitimacy of the last extension of the suspension pursuant to art. 54-ter of Law Decree no. 18/2020 of the executive procedures regarding properties constituting the principal residence of the debtor executed. Consequently, the six-month term which, pursuant to art. 627 of the Code of Civil Procedure, must be observed under penalty of extinction in order to resume proceedings, runs from January 1, 2021. The rulings of the Constitutional Court entail a regression of the illegitimacy of a rule of law or an act having such force to the time when they came into existence.
