This Privacy and Cookie Policy (“Policy“) applies to the processing of your personal data by Convecta S.r.l. Società tra Avvocati (hereinafter, “Convecta” or “Data Controller“) carried out through our website https://convecta.it/ (“Site“), pursuant to Regulation (EU) 2016/679 (“GDPR“), Legislative Decree 196/2003 as amended and the guidelines of the national and European data protection authorities, as well as applicable national and European legislation (jointly, “Applicable Legislation“).

The data controller is Convecta S.r.l. Società tra Avvocati, with registered office in Via Santa Fulcorina, 6 – 20123 Milan.   1. Types of personal data and processing methods

In order to achieve the purposes set out in section 3 below, we will process the following categories of personal data relating to you by both manual and automated means:

  • Common data: personal data collected through our Website, directly provided by you when requesting information (name and surname, information included in the message subject of the request, email address, information provided by you as part of the selection process such as date of birth, contact details, data relating to previous professional and/or academic experience, aptitudes).
  • Special categories of data: if you belong to protected categories. This data will only be processed by Convecta if you provide it as part of the information provided during the selection process.
  • Browsing data: data collected by us in the course of your browsing of the Site (ID and technical information about your device, details of the web browser used and your IP address and other information and/or parameters relating to your operating system and computing environment collected through the use of cookies and other tracking tools); please refer to the section on Cookies below for further information.

We process your personal data for the following purposes and under the following conditions of lawfulness:

  1. Data retention

We will retain data collected through the use of the Site for a period of time not exceeding that which is strictly necessary to achieve the purposes for which it was collected and for any longer period necessary to comply with legal obligations and/or for the purposes of judicial protection, subject to ordinary prescriptive terms, and in accordance with Applicable Law. In any case, e-mail correspondence, including any data contained in applications submitted through the Site, will be kept for a period of time not exceeding one year, unless there are legal requirements to keep it for a longer period.

  1. Nature of the provision of data

The provision of your personal data is necessary to be able to navigate and interact with the Site, as well as to be able to use the services it offers (in this regard, please refer to the purposes indicated in section 3 above). Any refusal to provide your personal data will consequently make it impossible for the Controller to respond to your requests and will not allow you to navigate and interact with the Site.

To the extent necessary to achieve the purposes set out in section 3 above, your personal data may be:

  • processed by our employees in the company departments responsible for pursuing the above purposes who have been expressly authorized to do so and who have received appropriate operating instructions;
  • made accessible to our suppliers including service providers (e. entities that provide specific legal and/or tax/tax advisory services, entities that provide information systems management and maintenance services), consultants and business partners, as well as to any judicial, administrative or other competent authority, in their capacity as autonomous data controllers or, subject to the signing of a specific contract pursuant to Art. 28 of the GDPR, data processors;
  • communicated to companies belonging to the same group, for administrative, accounting and/or legal reasons.

You may ask us at any time for a detailed and up-to-date list of such persons and their privacy qualifications.

Your personal data will not be disseminated.

Your data may also be collected by third parties when you accept third party cookies. Please see the Cookies section of this Policy for more information.

  1. Data transfer

 Where necessary in order to achieve the purposes set out in section 3 above, your personal data may be transferred outside the European Economic Area (“EEA“). Some of the entities listed in section 6 above may transfer your personal data to countries outside the EEA.

Whenever your personal data is transferred outside the EEA and, in particular, to countries that do not benefit from an adequacy decision of the European Commission, we will take one of the safeguards for this purpose set out in the Applicable Law, such as signing the standard contractual clauses adopted by the European Commission, keeping them up to date, and taking all other appropriate technical, organizational and/or contractual measures to ensure a level of protection for your personal data that is adequate and, in any event, essentially equivalent to that guaranteed within the EEA.

To the extent that these are applicable to the processing described in this Policy, you may exercise the following rights as specified in the GDPR:

  • the right to access your personal data collected and processed by us;
  • the right to obtain the updating, rectification, integration and restriction of their processing;
  • where the prerequisites set out in the Applicable Legislation apply, the right to have your personal data erased (“right to be forgotten”), the right to restrict the processing of your personal data and the right to data portability;
  • the right to object to the processing of data relating to you on legitimate grounds;
  • the right to receive your data in a structured, commonly used and machine-readable format and, if technically feasible, to transmit it to another data controller without hindrance (“right to data portability”).

If you believe that the processing of your personal data violates the principles laid down in the Applicable Law, you may file a complaint with the judicial authority or with the data protection supervisory authority in the Member State in which you normally reside or work or in which the alleged violation occurred. The competent authority in Italy is the Italian Data Protection Authority (“Garante“).
